Neb. judge throws out interview of suspect

NORTH PLATTE, Neb. (AP) _ A Lincoln County District judge has thrown out law enforcement's interview of a Sutherland man accused of sexually assaulting and killing his girlfriend's 4-year-old daughter. Judge Donald Rowlands ruled that Lincoln County Sheriff's investigators violated Donald Lee's Miranda rights when they interviewed him second time without a lawyer, even after he asked for one. The ruling means prosecutors cannot present evidence or testimony from the interview in Lee's trial, set for March 17. The 34-year-old Lee is charged with first-degree murder and sexual assault in the death of Ashlynn Gamble on July 19.
